NANAIMO -- A Parksville RCMP constable knew that a girl
he met on the Internet was under the age of consent when
he had sex with her in February 2006, a Nanaimo Provincial
Court judge heard yesterday.
Seth Paine, 32, is charged with one count of communicating
via a computer to lure a child under the age of 18, and
one count of touching a young person for a sexual purpose.
He was suspended from the RCMP after being charged.
The 16-year-old girl, who cannot be identified due to
a court-ordered ban, testified that in January 2006 she
posted a profile of herself on an adult website designed
for people "looking to sleep with each other."
When asked by prosecuting lawyer Marie-Sophie Poulin
what she was looking for at the time, the teen said she
was seeking confirmation that she was attractive.
She said she got some interest from other users of the
site, and responded to a user who called himself "one
hot cop for you," whose online profile included a
photograph of him wearing his RCMP uniform.
The teen said he was "cute" and that because
he was a police officer, she thought he "had to be
a decent human being."
E-mails read out in court by the teen revealed that she
at first told the accused she was "18 going on 19."
The teen testified she was gradually becoming interested
in him, but was worried that he might find out her real
age and tell her parents.
In e-mails back and forth, she said, she directed Paine
to a website with her correct age. Court heard he also
gave her his RCMP cellphone number and they later initiated
contact.
The witness testified that on Feb. 21, 2006, during a
break from her school day, she met with the accused and
they had consensual sex.
The trial continues today.
